Congress and President Obama have divided the world of group health plans in two—“new” group health plans adopted after the March 23, 2010 passage of the Patient Protection and Affordable Care Act (PPACA) that must conform to the requirements of the new law, and “grandfathered” plans which are largely exempt from the new law’s requirements.

Grandfathered Status -
What Does it Mean to my Plan?

There has been and will continue to be much ado about grandfathered status, at least until all plans have lost it (and eventually all will lose it). When President Obama introduced the Patient Protection and Affordable Care Act (PPACA), he pledged that “If you have insurance that you like, then you will be able to keep that insurance.” You will have to decide if that promise has been kept or broken.

The articles included in this newsletter present varying viewpoints on the importance of maintaining grandfathered status and are intended to help you decide how important it is to your plan. On June 17, 2010, the Internal Revenue Service, Department of Labor, and Department of Health and Human Services released interim final regulations (the "Regulations") in an
attempt to resolve ambiguity regarding the changes that affect a plan's grandfathered
status.

HHS: Grandfathered status is not an all or nothing proposition.

The concern by employers that changing one of their plans could cause all plans to lose grandfathered status is a little clearer thanks to federal regulators.  Previously HHS, DOL and the Treasury Department held that grandfathered status would be lost for all plans if employers changed one plan.
